While it’s not a legal requirement to use a RICS-qualified surveyor for probate or inheritance tax purposes, with many people opting to have a valuation carried out with an estate agent, there are factors that may make choosing an RICS registered valuer preferable.

HMRC is more likely to scrutinise valuations that haven’t been carried out by a RICS-accredited professional. If a submitted valuation appears unusually low or inconsistent with local market data, HMRC may challenge it. In such cases, the estate agent would need to provide a formal explanation, and a new valuation could be requested.

If HMRC determines that a property’s value was deliberately understated to reduce inheritance tax, they may impose a penalty of up to 100% of the underpaid tax – a risk that can affect both executors and beneficiaries.
